Subletting a flat

Subletting an apartment - this is how it works!

  1. obtain consent

    If you do not own the property you want to sublet, but you still want to rent it out, you can sublet the apartment. In German law, this is allowed under conditions. One of these conditions is that you have to discuss the subletting with the landlord and specify the conditions. The goal should be to still live there in the future.

  2. conclude a rental contract

    A rental agreement is not a must at first, but it should be concluded so that you do not take any risks. In case of need, get notarial or legal help to draw up the contract.

  3. rent and deposit

    In the lease agreement you have to determine a rent and deposit. Any additional income from the sublease must be taxed. The rent should be paid on time, because...

  4. risks and possible problems

    ...the sublessee can otherwise be kicked out of the apartment just like the sublessee. He is virtually liable for his subtenant. If the landlord does not get his money in time or the subtenant makes other problems, this falls on the feet of the subtenant.

  5. Termination

    First of all, it is important whether the contract is for a limited or unlimited period. If the contract is for a limited period of time, the sublessor can ask the subtenant to leave the apartment after the contract has expired without giving any reasons. Otherwise, not only the sublessor has the right to terminate the contract, but also the sublessee. He can also get out of the contract after giving reasons.
